ARTICLE 2 – PURPOSE

These conditions govern the sales by the aforementioned Company KYS of all products sold, whether jewelry, stones, objects, decorations, lamps, incense, clothing, and any other products or services related thereto.


ARTICLE 3 - APPLICATION OF THESE GENERAL CONDITIONS OF SALES – CGV

The general conditions of sale thus presented apply to any purchase from the KYS Company on its online store via the website https://www.karma-yoga-shop.com . To find out the conditions of his order, the customer can click at any time, even before placing an order on “general conditions of sale”.

Placing an order implies the customer's full and unrestricted acceptance of the various clauses presented in these General Terms and Conditions.

The offers presented by KYS are reserved exclusively for private customers, that is to say that it acts for purposes which do not fall within the framework of its commercial, industrial, artisanal or liberal activity. The latter acknowledges having full legal capacity to commit to the general conditions of sale.

The customer declares before validation of his order to have accepted these General Terms and Conditions and consequently to fully adhere to them.


ARTICLE 4 – ORDER CONDITIONS

All conditions are carried out on the site https://www.karma-yoga-shop.com .

The customer creates a basket by choosing the number of products they want. A summary which includes all the elements of the basket is displayed before validating your basket. The customer can, at this stage, check, modify and delete the selected products. Once their selection has been made, the customer validates their basket by clicking “Payment”. Any order not validated cannot be honored. The simple fact of adding a product to the basket does not constitute validation of the order.

If the User has added the KYS Privilège service to their basket, they will be able to benefit from a free month of subscription to the KYS Privilège Services. At the end of this month of free subscription, and unless terminated before the expiration of this first one-month period offered (see article 9 of these General Conditions of Sale), the subscription to the Services will be tacitly renewed for price and according to the frequency reminded to the User in the details of their order, and this before any final validation of the latter. As long as he has not definitively validated his order, the User can freely and completely modify his basket of chosen Products and Services.

After validating, the customer then selects their payment method.

After accepting the General Terms and Conditions, orders become final when validated by payment for the products and/or services.

An invoice will be issued by KYS and sent to the customer's email address when their order is shipped. An order confirmation is sent by email immediately after payment.

This confirmation will resume:
– All the constituent elements of the contract entered into between the Parties;
– Details of the Products purchased;
– Details of the Services subscribed as well as details relating to the Subscription to the Services.

Any possible non-receipt of said email, for whatever reason (for example communication by the User of an incorrect email address, filtering by antispam, etc.), is not likely to call into question the validity of the email. the order of the Customer User (Products purchased, subscription to the Services subscribed).

The KYS Company recommends that the Customer keep their order confirmation email or print it. However, documents archived in
the computer systems of the KYS Company. A summary of the order will also be available in the User's Customer Account, in the “My Orders” section of “My Account”.

In accordance with the terms of law n°80336 of May 12, 1980 amended on May 13, 1980, relating to retention of ownership, the KYS Company retains full and complete ownership of the products sold until full payment of the price, in principal, costs and taxes Understood.

The customer becomes owner and responsible for the items upon delivery, the transfer of possession being equivalent to transfer of risks.

Unless proven otherwise by the customer, the automatic recording systems of the site and the seller's reserved area are considered as proof of the nature, content and date of the sales contract.

The seller reserves the right to adapt or modify the general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order. Special case of subscribing to a Subscription to the Services

As recalled in article 4 of these General Conditions of Sale, Subscriptions to the Services are Subscriptions with tacit renewal.

In the event of subscribing to such a Subscription with tacit renewal, the subscription is payable in advance at the start of each period, by recurring payment by credit card, via secure access on the Site. The first debit is made on the day of the first subscription to the Subscription. Flow rates
following are carried out on the anniversary date of the Subscription according to the frequency stipulated in the order details and on the payment page of the Site.

In the event that a free Trial Period is offered to the User, as is the case with the month of free access to the KYS Privilège Services, offered with any Product order (see article 4 hereof), the first fee will only be collected by the KYS Company at the end of this Free Trial Period.

The User acknowledges that the communication of information relating to his bank card constitutes authorization to debit his bank account via his bank card number, for the benefit of the Company KYS, up to the amount of the Subscription subscribed. and according to the frequency stipulated in the summary of your order on the Site.

In any case, before subscribing to any subscription, the User is invited to read its price and its possible renewal terms before proceeding with the final validation of their order. The possibilities of withdrawal and termination of subscriptions to the Services taken out by the User Client are specified in article 6.B of these General Conditions of Sale.


ARTICLE 5 – PRODUCT – AVAILABILITY OF THE PRODUCT, PAYMENT METHODS AND PRICE

A – PRODUCTS

C – Price

The prices indicated on the site depend on the KYS Company.

For France, prices are expressed in Euros (€) and displayed all taxes included (French VAT and all other applicable taxes). For other countries of the European Union, the price differs depending on the country of delivery of the product and will take into account the local VAT of the country of consumption and other taxes (excise.).

Outside the EU, invoicing is expressed in Euros (€), and without the application of any conversion costs. The non-EU customer must pay any customs duties or other local taxes, bank charges, import duties or state taxes that may be payable. These rights and sums do not fall within the jurisdiction of the KYS Company.

The price indicated on the site is indicated excluding processing and transport costs. On the same product, the price may vary depending on the quantities chosen. Transport costs vary depending on the delivery method chosen by the customer and the country of delivery. The delivery rates applicable when ordering are available on the site.

All orders regardless of their origin are payable in euros.

The KYS Company reserves the right to modify its sales prices, but the product will be invoiced on the basis of the price in force at the time of validation of the order and subject to availability.

D – Security of transactions

ARTICLE 5 BIS – SERVICES

A – DEFINITIONS

“Services” refers to all KYS Privilège services presented on the Site and accessible to Users. These are the services presented in article 3 of these General Conditions of Sale, as well as through the dedicated pages of the Site.

These Services are exclusively offered and provided by the KYS Company , and subscribed to by the User as part of a Subscription offered by the KYS Company .

“Subscription”: This is a paid package which allows access to the Services to which the User wishes to subscribe and access. The Subscription offered by the KYS Company is a contract of indefinite duration, without commitment and can be canceled at any time. This Subscription of indefinite duration is renewed monthly at the end of a trial period if necessary, by tacit renewal, subject to payment of the price of the Subscription.

“Trial Period”: This is, within the framework of a Subscription, a period during which the User can test the Services. Throughout this trial period of the Services, the User can freely terminate their Subscription.

The User who would like to purchase Products and/or subscribe to the Services offered for sale online on the KYS Company Site, declares to be of legal age and to have full legal capacity to make these purchases and/or subscriptions.

B - DESIGNATION OF SERVICES

In addition to its Products, the KYS Company also offers online training services and privileges reserved for subscribers.
These Services are those appearing on the Site, on the day of their consultation by the User.

Any Product order entitles the Customer to one (1) month of free access to the KYS Privilege Services of the KYS Company , in order to help and support the User in their learning process.

C - PRICES OF SERVICES

C.1 Trial Period:

As stipulated in article 5. BIS B, any Product order entitles the Customer to benefit from a free one (1) month Subscription to the Services, if he/she expressly requests it by adding the product KYS Privilège in your basket.

In this case, the Customer then has a Subscription with a Trial Period of one (1) month, starting to run from his subscription to the Services. During this Trial Period, the Client User can therefore test the Services free of charge and, where applicable, freely denounce their
Subscription if these Services do not bring full satisfaction.

If, as part of the Trial Period, the Customer User wishes to cancel their Subscription, they must simply log into their customer account and validate their unsubscription in the “My
Account” or via the “ Unsubscribe ” link present on all pages of the site, or contact the Customer Service of the Company KYS, by email, to notify them of this decision before the expiration of the Trial Period . Customer Service will acknowledge receipt of their request and the User will obviously not be subject to any invoicing for the service.

Note: The benefit of this Trial Period is only valid once per Customer User.

C.2 Subscription:

At the end of the first month of free subscription, and in the absence of termination, the Subscription with Trial Period is then renewed as a Subscription to the Services, renewed automatically every month.

The price of the Subscription to the Services is then 29.90 (€) including VAT (All Taxes Included), per month.

The Subscription to the Services is taken out for a tacitly renewable period.

This Subscription is without obligation and can be canceled at any time.

Payment for the Subscription is made under the conditions provided for in article 6 “Payment” below.

ARTICLE 6 – RIGHT OF WITHDRAWAL

A - PRODUCTS

In accordance with the provisions of article L.121.21 of the Consumer Code, you have a period of fourteen (14) days from receipt of your products to exercise your right of withdrawal without having to provide reasons or pay penalties. Karma Yoga Shop has decided to extend this period to thirty (30) days.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to frustrate the right of withdrawal.

Return costs are the responsibility of the customer.

In the event of exercising the right of withdrawal, the KYS Company will reimburse the sums paid, within fourteen (14) days following notification of your request and via the same means of payment as that used when placing the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

• The provision of services fully executed before the end of the withdrawal period and whose execution has begun after the express prior consent of the consumer and express waiver of his right of withdrawal.
• The supply of goods or services whose price depends on fluctuations on the financial market beyond the control of the professional and likely to occur during the withdrawal period.
• The supply of goods made to the consumer's specifications or clearly personalized.
• The supply of goods likely to deteriorate or expire quickly.
• The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
• The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items;
• The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations on the market beyond the control of the professional.
• The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
• The supply of a newspaper, periodical or magazine, except for subscription contracts for these publications.
• Transactions concluded at a public auction.
• The supply of digital content not provided on a material medium whose execution has begun after the express prior agreement of the consumer and express waiver of his right of withdrawal.

B - SERVICES

In accordance with the commercial policy of the Company KYS and the French regulations in force, the Customer has a period of fourteen (14) calendar days to renounce his membership to the Services from the date of subscription of his Subscription, this without penalty and without reason.

At the end of this period, the right of withdrawal becomes irremediably void. Thus, within the aforementioned fourteen (14) day period, the Customer may exercise his right of withdrawal from the KYS Company:
– Either by means of a withdrawal form established in accordance with the regulations in force and made available upon simple request made to the Customer Service of the Company KYS ;
– Either by any other unequivocal written means, for example by sending a postal or electronic letter to the Customer Service of the Company KYS in which the following information will be mentioned:
Name, first name, address, telephone number, email address of the Customer, as well as the designation of the Subscription taken out, subject of the exercise of the right of withdrawal (designation must contain the references of the Subscription, date of subscription, duration, billing cycle and amount billed for the title
of said Subscription).

Upon receipt of either the withdrawal form or the aforementioned writing, the Company will acknowledge receipt. Then, within fourteen (14) days maximum from this date of receipt, the Company will reimburse all sums paid by the Client User under the
the Subscription taken out, subject to the exercise of the right of withdrawal.

Option to terminate the Subscription purchased:

At any time, free of charge and without reason, the Client User can cancel their Subscription directly in their member area of ​​the Site which they access using the identifiers attached to their Client Account. Termination decided by the Client User will be effective immediately, without penalty, but it
will in no case result in the reimbursement of the period remaining until the end of the Subscription taken out. Indeed, given the nature of the Services, each month started is owed in full by the Client User and cannot, therefore, be the subject of any reimbursement request.

An email will be sent to the Client User confirming that the termination of his Subscription, which occurred on his initiative, has been taken into account.

Furthermore, if necessary, technical assistance is made available to Users through the “Contact Us” section of the Site.


ARTICLE 7 – DELIVERY

Upon receipt of payment for the order, the KYS Company launches delivery operations within the time indicated on the order validation page, it being specified here that delivery times are given for information purposes only. Delivery of ordered items is made to the address provided by the customer. The delivery information indicated by the customer is binding on the customer. In the event of an error or lack of information, defect or absence of delivery, the KYS Company cannot be held responsible. In the event of a return due to an incomplete address, the customer will have the option of either changing their address and having the goods reshipped while paying the new return costs, or having the order refunded after deducting the initial shipping costs. Shipping pricing will be based on the country where the customer is located.

In the event of a shipping delay, an email will be sent to you to inform you of a possible impact on the delivery time indicated to you.

In accordance with legal provisions, in the event of late delivery, you have the possibility of canceling the order under the conditions and procedures defined in article L 138-2 of the Consumer Code. If in the meantime you receive the product we will reimburse it and the delivery costs under the conditions of article L 138-3 of the Consumer Code.

In the event of deliveries by a carrier, the company KYS cannot be held responsible for late delivery due exclusively to unavailability of the customer after several appointment proposals.

The customer, in the event of delivery by a carrier, is responsible for checking the contents of the package upon receipt and making reservations if necessary.

ARTICLE 8 - GUARANTEE

A - PRODUCTS

All products supplied by the company KYS benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, or hidden defects, it may be returned to the KYS company which will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made by email to contact@karma-yoga-shop.com within thirty days after delivery.
The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed to you on the basis of the price invoiced and return costs will be reimbursed upon presentation of supporting documents.

The provisions of this Article do not prevent the customer from benefiting from the right of withdrawal provided for in Article 6.

B - SERVICES

“Satisfied or Reimbursed” commercial guarantee on the Services

Principle:

In addition to the right of withdrawal and the right to terminate (article 6 of these General Conditions of Sale), but also the right to terminate the Subscription during the Period
Free Trial (see article 4 of these General Conditions of Sale), the KYS Company also offers its Customer Users an additional commercial guarantee on its Services applicable in the event of non-satisfaction.

This additional commercial guarantee applies to any Subscription (whether this Subscription is initially taken out, or whether it concerns the renewal of a Subscription at the end of the Free Trial Period, in the absence of notice (see article 4.2. of these General Conditions
of Use and Sale).

The KYS Company thus undertakes to reimburse, to any Customer User who has canceled their Subscription under the conditions set out in Article 6.B of these General Conditions of Sale and who requests it under the conditions presented below, the last transaction relating to the Subscription
subscribed, if the latter is not satisfied with the Services rendered.

Terms :

To assert this commercial guarantee, the Customer must first contact the Customer Service of the Company KYS (via the “contact us” section of the Site) to precisely describe the reason for their dissatisfaction. He will then be asked to clearly explain the reason for his dissatisfaction. For its part, the KYS Company will verify that the request has not been made fraudulently or in bad faith, it will in particular verify that this request is not abusive (for example, by way of illustration and not limitation, the KYS Company will verify that the Client User has not repeatedly used all or part of the various Services made available to him through his Subscription, without ever having once made any complaint to the Customer Service of the Company KYS as to to the quality of the Services provided). If the KYS Company responds to its request, Customer Service will then proceed with the requested reimbursement within fifteen (15) days from the date of receipt by the KYS Company of the reimbursement request.

The refund will be made via the payment method used by the Customer User when ordering, that is to say exclusively via their bank card.

The Client User is notified by email as soon as the reimbursement is made to the account attached to their bank card.

This additional commercial guarantee is strictly limited to a single reimbursement request per Customer User.


ARTICLE 9 – LIABILITY

The products offered comply with current French legislation. The KYS company cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the customer's responsibility to check with local authorities the possibilities of importing or using the products that the customer plans to order.

Furthermore, KYS cannot be held responsible for damage resulting from improper use of the purchased product.

Finally, the company KYS cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

ARTICLE 10 – LAW APPLICABLE TO DISPUTES

The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.

ARTICLE 11 – INTELLECTUAL PROPERTY

All elements of the site https://www.karma-yoga-shop.com are and remain the intellectual and exclusive property of the company KYS. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. The customer is informed that the KYS Company implements processing of personal data in order to enable it to manage orders, ensure invoicing and possible complaints, as well as to improve the services and information that we adress you. The KYS Company reiterates its commitment to scrupulously respect law no. 78-17 of January 6, 1978 relating to “computing, files and freedoms” and the General Data Protection Regulations (GDPR). The KYS Company undertakes to ensure the best level of protection for the customer's personal data in accordance with the Data Protection Act No. 78-87 of January 6, 1978 relating to data processing, files and freedoms as well as the law No. 2004-801 of August 6, 2004 amending it, relating to the protection of individuals with regard to the processing of personal data, and Commission Regulation No. 2016/679 (GDPR). The KYS Company implements organizational, technical, software and physical measures in terms of digital security to protect personal data against alteration, destruction and unauthorized access.

The KYS company is required to ask the customer for a certain amount of personal data. The collection of this data is done through a form, as well as through the use of cookies. Some data is mandatory and is designated with an asterisk.

Data relating to means of payment (in particular the bank card number) are not processed or collected by the KYS Company but by its service provider. Personal information provided during visits to the site is strictly confidential.

The storage of personal data is kept at the hosting provider Shopify, whose servers are located in Canada, for the duration necessary to achieve the aforementioned processing purposes.

The hosting provider presents a sufficient level of protection with regard to European regulations, allowing the transfer of personal data to its servers. This applies the standard contractual clauses of the Commissions

European standards for the transfer of personal data, as well as the ISO27018 and 27701.15 standards.

The customer has a right of access, rectification and opposition to personal information and personal data concerning him, directly on the website.

ARTICLE 13 – ARCHIVING / PROOF

The KYS Company will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

ARTICLE 14 – FORCE MAJEUR

The KYS Company disclaims its liability for any failure to fulfill its contractual obligations in the event of force majeure or fortuitous circumstances, including, but not limited to, disaster, fire, internal or external strike, internal or external failure or breakdown, and in general any event that does not allow the proper execution of orders.

ARTICLES 15 – APPLICABLE LAW AND RESOLUTION OF DISPUTES

This identifier certifies its compliance with its obligation to register in the register of producers of Electrical and Electronic Equipment and the completion of its marketing declarations with ecosystem.

Unique ID number (IDU) for the EA sector: FR030462_10B6KZ

KYS SAS is registered in the National Register of marketers of furniture items under number FR030462_10B6KZ. This number guarantees that KYS SAS, by joining Eco-mobilier, is in compliance with the regulatory obligations incumbent upon it pursuant to article L541–10–6 of the Environmental Code.

ARTICLE 17 - FINANCING THE COLLECTION, SORTING AND RECYCLING OF HOUSEHOLD PACKAGING WASTE

KYS SAS is registered as a producer of household packaging with the eco-organization Citeo, under the Unique Identifier FR030462_01IPWT. This registration allows us to contribute to financing the collection, sorting and recycling of household packaging waste in France, in accordance with current regulations. We are therefore committed to an eco-responsible approach to reduce our environmental impact, while ensuring optimal management of our packaging.

ARTICLE 18 - REGISTRATION IN THE REGISTER OF PRODUCERS OF SPORTS AND LEISURE ARTICLES
